If you are fleeing persecution in your home country and seeking protection in the UK, submitting an initial asylum application is the critical first step. This comprehensive guide explains the process, eligibility requirements, deadlines, and tips for a successful asylum claim in 2025.

You must apply for asylum if you want to stay in the UK as a refugee.

Who is eligible for asylum claim?

To stay in the UK as a refugee you must be unable to live safely in any part of your own country because you fear persecution there.

If you’re stateless, your own country is the country you usually live in.

This persecution must be because of:

  • your race
  • your religion
  • your nationality
  • your political opinion
  • anything else that puts you at risk because of the social, cultural, religious or political situation in your country, for example, your gender, gender identity or sexual orientation

When can I apply for asylum application?

You should apply when you arrive in the UK or as soon as you think it would be unsafe for you to return to your own country. Your application is more likely to be refused if you wait.

You can get up to 2 years in prison or have to leave the UK if you give false information on your application. We never support fake asylum cases, and we never encourage anybody to make fake asylum cases.

What happens after initial asylum application?

After the initial asylum application, you will be called for the asylum screening interview. When you apply, you’ll have a meeting with an immigration officer (known as a ‘screening’).

After your substantive interview, the Home Office will assess your claim. They may:

  • Grant asylum (refugee status) – allowing you to stay for 5 years
  • Grant humanitarian protection – if you don’t qualify as a refugee but still face serious risk
  • Refuse your claim – in which case you may appeal the decision

You may be placed in asylum accommodation and receive asylum support during the application process if you are destitute.

What documents do I need for an asylum application?

You’ll need documents for yourself and your dependants (partner and children under 18) for your asylum screening.

Documents you should bring (if you have them) include:

  • passports and travel documents
  • identification documents, for example identity cards, birth and marriage certificates or school records
  • anything you think will help your application

If you’re already in the UK, you and your dependants must bring documents that prove your UK address.

You’ll need different documents depending on whether you’re living in your own accommodation or staying with someone else.

How Long Does the Asylum Process Take in the UK?

The Home Office aims to decide most straightforward cases within 6 months, but many applicants wait longer due to case backlogs. You cannot work while your claim is pending unless your case has taken over 12 months and you meet specific criteria.

Common Reasons for Refusal

❌ Applying after passing through a ‘safe third country’
